Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Get Home Safe™ mobile application (“App”) and related services (“Services”) provided by Strike First Fitness, Inc. (“Strike First Fitness,” “we,” “us,” or “our”).

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, do not download, install, or use the App.

1. Purpose of the App

Get Home Safe™ is a personal safety and preparedness application designed to help users plan, communicate, and take reasonable precautions while traveling, working, attending events, or engaging in other activities.

The App may provide features such as safety planning, check-ins, safety reminders, emergency-contact communication, location-related functions, safety information, and other personal-safety tools.

The App is a safety-support tool. It is not a substitute for personal judgment, situational awareness, professional emergency services, law enforcement, medical care, or other appropriate emergency assistance.

2. Not an Emergency Service

Get Home Safe™ is not an emergency response service, 911 service, law enforcement service, medical service, security company, or monitoring center.

The App does not guarantee that police, fire, ambulance, emergency personnel, security personnel, emergency contacts, or any other person will receive, respond to, or act upon an alert or communication initiated through the App.

If you are experiencing an immediate or life-threatening emergency, contact 911 or the appropriate emergency service directly.

Do not rely solely on the App during an emergency.

3. No Guarantee of Personal Safety

Use of the App does not guarantee that you will avoid injury, illness, assault, theft, accident, property loss, or any other dangerous or unwanted event.

Strike First Fitness does not represent or warrant that use of the App will prevent an incident from occurring or that the App will successfully protect you in every situation.

You remain responsible for your own safety, decisions, actions, and responses to changing circumstances.

You should always use reasonable judgment and seek appropriate professional or emergency assistance when necessary.

4. Location Services

Certain App features may use your device's location services, GPS, cellular network, Wi-Fi, Bluetooth, or other location technologies.

Location information may be affected by GPS availability, cellular coverage, Wi-Fi availability, device settings, operating-system restrictions, battery level, indoor or underground environments, weather or physical obstructions, network congestion, inaccurate device information, or technical failures.

Accordingly, Strike First Fitness does not guarantee that location information will always be available, accurate, current, or transmitted successfully.

If you disable location services or otherwise restrict the App's access to location information, certain features may not function properly.

5. Mobile Device and Internet Requirements

The App requires a compatible mobile device and may require access to cellular, Wi-Fi, Bluetooth, GPS, or other communications services.

You are responsible for:

• maintaining a compatible device;
• keeping your device sufficiently charged;
• maintaining an active cellular or internet connection when required;
• maintaining appropriate device permissions;
• installing applicable App updates; and
• ensuring that your device is functioning properly.

Strike First Fitness is not responsible for failures caused by your device, cellular carrier, internet provider, operating system, network outage, battery failure, or other technology outside our reasonable control.

6. Emergency Contacts

You may have the ability to designate one or more emergency contacts or other individuals to receive information or alerts through the App.

You are responsible for:

• providing accurate contact information;
• obtaining any permission necessary to provide another person's information to the App;
• ensuring that your emergency contacts understand their role; and
• keeping your emergency-contact information current.

Strike First Fitness does not guarantee that an emergency contact will receive an alert, see an alert, respond to an alert, or be able to assist you.

7. User Responsibility

You agree that you are responsible for your use of the App and for decisions you make based upon information provided through the App.

You should not use the App in a manner that distracts you from driving, operating machinery, crossing streets, navigating hazardous environments, or responding appropriately to an immediate threat.

Do not use the App in a manner that creates an additional safety risk.

8. Safety and Self-Defense Information

The App may contain educational information concerning personal safety, situational awareness, risk reduction, conflict avoidance, de-escalation, and related subjects.

This information is provided for general educational purposes only.

Information contained in the App does not constitute legal advice, medical advice, mental-health advice, law-enforcement advice, security consulting, emergency response instructions, or a guarantee of a particular outcome.

Individual circumstances vary. Users should exercise independent judgment and seek qualified professional assistance when appropriate.

9. User Accounts and Information

If the App requires an account, you agree to provide information that is accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to notify Strike First Fitness promptly if you believe your account has been accessed or used without authorization.

10. Privacy

Your use of the App may involve the collection and processing of personal information, which may include information such as your name, email address, phone number, emergency-contact information, device information, and, where applicable, location information.

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using features that require location, contacts, notifications, or other device permissions, you authorize the App to use those permissions for the applicable features you have enabled, subject to the Privacy Policy and applicable law.

Please review our Privacy Policy before using the App.

11. Data Accuracy

We make reasonable efforts to provide useful and reliable Services. However, information transmitted through the App may be delayed, incomplete, unavailable, or inaccurate.

You acknowledge that technology and communications systems can fail.

Strike First Fitness does not guarantee:

• uninterrupted availability of the App;
• uninterrupted communications;
• continuous GPS availability;
• accurate location information;
• delivery of every notification or alert;
• delivery within a particular amount of time;
• compatibility with every device; or
• error-free operation.

12. Prohibited Use

You agree not to use the App:

• for any unlawful purpose;
• to harass, threaten, stalk, or intimidate another person;
• to impersonate another person;
• to transmit fraudulent or misleading information;
• to interfere with the operation or security of the App;
• to attempt to gain unauthorized access to the App or its systems;
• to reverse engineer, decompile, or disassemble the App;
• to copy or redistribute the App or its content without permission; or
• in any manner that could damage, disable, overburden, or impair the Services.

Strike First Fitness may suspend or terminate access to the App for violations of these Terms.

13. Intellectual Property

The Get Home Safe™ name, logo, branding, content, graphics, text, instructional materials, software, designs, and other materials associated with the App are owned by or licensed to Strike First Fitness unless otherwise indicated.

Nothing in these Terms grants you ownership of any intellectual-property rights belonging to Strike First Fitness.

You may use the App solely for your personal, lawful use in accordance with these Terms.

You may not reproduce, distribute, modify, sell, license, publish, or commercially exploit App content without prior written authorization from Strike First Fitness.

14. Third-Party Services

The App may rely upon or interact with third-party services, including cellular networks, internet providers, mapping services, device operating systems, app stores, notification services, payment processors, or other technology providers.

Strike First Fitness does not control and is not responsible for the availability, performance, policies, or practices of third-party services.

Your use of third-party services may also be subject to those providers' separate terms and privacy policies.

15. App Store Terms

If you download the App through Apple App Store, Google Play, or another third-party marketplace, additional terms may apply to your use of that marketplace.

These Terms govern your relationship with Strike First Fitness regarding the App and do not replace the applicable terms imposed by the relevant app marketplace.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App and Services are provided on an “as is” and “as available” basis.

Strike First Fitness disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, reliability, and security, except to the extent such disclaimers are prohibited by law.

We do not warrant that the App will operate without interruption, error, delay, or failure.

17. Limitation of Liability

To the maximum extent permitted by law, Strike First Fitness and its owners, officers, employees, contractors, affiliates, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the App or Services.

This includes, to the extent permitted by law, claims arising from:

• failure or delay of an alert;
• failure or delay of a notification;
• inaccurate or unavailable location information;
• failure of an emergency contact to respond;
• cellular or internet outages;
• device or battery failure;
• loss or interruption of data;
• technical malfunctions; or
• personal injury, property damage, or other loss resulting from reliance on the App.

Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.

18. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Strike First Fitness and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from or related to:

• your violation of these Terms;
• your misuse of the App;
• information or content you submit through the App;
• your violation of another person's rights; or
• your unlawful or unauthorized use of the App.

19. Changes to the App

Strike First Fitness may modify, update, suspend, or discontinue any portion of the App or Services at any time.

Features may be added, removed, modified, or replaced as the App develops.

We may also release updates that are necessary for security, functionality, compatibility, or performance.

20. Changes to These Terms

We may update these Terms from time to time.

When material changes are made, we may provide notice through the App, website, email, or other reasonable means.

Your continued use of the App after updated Terms become effective constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.

21. Termination

You may stop using the App at any time.

Strike First Fitness may suspend or terminate your access to the App if you violate these Terms, misuse the Services, or engage in conduct that could harm the App, other users, Strike First Fitness, or third parties.

Sections concerning intellectual property, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive termination will survive termination.

22. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute that cannot be resolved informally shall be handled in a court of appropriate jurisdiction in Georgia, unless applicable law requires a different forum.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

24. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms specifically applicable to particular App features, constitute the agreement between you and Strike First Fitness concerning your use of the App.
